We have a series of Australian governments that are guilty of crimes against humanity, independent federal MP Andrew Wilkie recently told Q&A. Is he right?

Independent federal MP Andrew Wilkie recently condemned successive Australian governments for failing to meet their obligations under international law to asylum seekers and refugees who arrive by sea."The Rome Statute addresses crimes against humanity, and it's a crime against humanity to forcibly transfer anyone to a third country and to detain them indefinitely without trial.RMIT ABC Fact Check investigates.

Lawyers and academics have also called on the court to investigate, but to date, no such investigation has been launched. International criminal law experts consulted by Fact Check said that, in theory, the ICC could decide to investigate Australian government officials.Furthermore, even if the ICC investigated, and then decided to launch a prosecution, the Australian Government could refuse to volunteer its officials for a trial, they said.Fact Check has not assessed the extent to which Australia's treatment of asylum seekers meets the Rome Statute's definition of crimes against humanity.

Yes

Poor down trodden fakeugees are forced, forced I tell you to go to an icecream parlour or the beach completely unguarded. So by your reckoning not allowing the to cone to Australia but they are free to go any where else in the world is a crime against humanity? Pigs arse it is.

Yes

I don't know about Australia but by the looks of this video these 'refugees' are guilty of crimes against comedy 😂🤣

But wait, PDut told me they were rapists and murderers come to plunder our queues - not humans!

The analysis of GLAN_LAW, Stanford Law School and a number of international criminal law experts suggests the ICC Prosecutor should investigate. See here:

Well he was right on Howard and the Iraq war.

Absolutely not

What about this 2017 settlement?

The LNP have so broken the ABC that Fact Check doesn't actually answer? 🥴

So yes?

Yes

Yep.

Untested ... but more than likely

Yes

the is guilty of crimes against the Australian people. defundtheabc

Yes

Not one bit.

Is it a crime to protect ones sovereign state from unknown threats? No. Is it a crime to ensure all people meet the criteria for refugee status prior to being allowed into a country. No. So no we are not commiting any crime against humanity

Extraordinary inaccurate“fact check” not one mention of PM Gillard who set up detention camps in Nauru and PNG in Aug/Sept 2012 breaking Australia’s commitment to the 1954 UNHCR Convention - auspol ABCFactCheck - WilkieMP - Grossly inaccuracy or inadequate? who pays for this?

QandA Holding people including women and children for years without charge.....of course not!

Absolutely

No.

Exploiting workers pay low as $4 a hour,as we know last year when the Fair Work Commission, stated the minimum wage, Coalition Gov. parliamentary, used the TV. time advocating against the minimum wage rise, further worse she claimed that the minimum wages, was very unfair to boss

Yes

QandA No. If we were someone would have tried a claim long ago. There are are litterally 100s of socialist lawers and students foaming at rhe mouth over such a prospect.

Legally? Maybe not, as the article states. Morally, however, there is no question.

Lynmaree56 I blogged my view that Australia is guilty of crime against humanity on in 2013, 2015 So I would really like to see that question tested in an appropriate forum. auspol

Yes

This bloke is all piss and wind and anti Australian

Yes, and those that say no will be happy to say yes if any socialist country has done the same crimes. Those that say know also agree that Kissinger deserves the Peace Noble Prize.

Qldaah Of course it is dickheads when you play politics with peoples lives from war torn countries that are backed by the west of course you guilty.

In addition, international law cannot be imposed, it relies on the respective country to accept a ruling and abide by it.

Who gives a rats

Geez 'untested' is hardly reassuring

QandA Yes

Is The Australian ABC guilty of Bulls%t against Australia in its Fake News about Fake Refugees?

QandA The 1951 Refugee Convention allows for signatory countries to offer asylum to people who meet the criteria. It also sets out that signatory countries take refugees from areas of concern. People are held in detention until the threat they pose to the country can be determined.

no. look after your own first

It should be tested. Thats a pretty weak assessment, how about 'Is Australia committing crimes against humanity and not being investigated'?

QandA Fact check this, are they in need of asylum?

QandA For all the snowflakes saying 'Yes'.... Did you actually read the Fact Check?

QandA The case against Australia was 'fairly weak', he said. A definitive judgment on whether successive Australian governments had committed crimes against humanity was not possible, he said. End.

If intermittent WiFi access isn't a crime against humanity, I don't know what is.

YES

Yes of course!!

Bring guilty and being prosecuted are two different things.

Yes

QandA O well that's alright then

no...that's absurd

If they follow this silly eurotrashy idea, our govt would have its soveriegnty overuled by lefthards from Germany & France. We are Australia. We decide who comes, & the manner in which they arrive.

Hell yes ! Indefinite detention is torture

Qldaah Yes, unfortunately we are all guilty of these crimes

Oh please stop with this rubbish. They are treated better than many Australian citizens

somuchbullsh Needs testing! auspol

ABCFactCheck typical abc question

Does a bear shit in the woods?

Andrew Wilke lives in an alternate universe

Oh let’s get Wilkie to run the matter in The Hague. Pro bono types can’t wait. Andrew did so well on gambling. Gillard used the poor sod.

No. Look to China, Iran, Pakistan, Saudi Arabia, Zimbabwe, North Korea, Syria, Turkey, Libya, Somalia etc.

When labor has increased the amount of boat people dying at sea because of relaxed borders they will use the deaths as political headway to virtue signal the vote base instead of stopping incentivizing and saving childrens lives. Truly divisive.

QandA Yes. But they use slogans to sell process. 'We stopped boats.''1500 deaths at sea'. 'ALP's border mess.' To punish innocent people as a means of scaring off other innocent people is not a moral way of achieving good ends. Alternative policies should have been used to save lives.

QandA How about this question: Should Australia look after its indigenous people before taking in illegal immigrants?

Ten years on and people still dont understand border policy.

The answer if you dont want to read that is NO

QandA Yes.

QandA Absolutely.

QandA Gosh it’s complex isn’t it? Not much hope of a conviction but we know how cruel and evil they are to asylum seekers. And they are judged guilty in the court of decent public opinion on a daily basis. And at the election we hope.

Yes, yes & yes

Of course not better looked after than many Australian citizens

Comment? Afraid...deportation!

Yes yes yes

give us a break Spare us d sanctimonius lecture Refugees in Greece& Turkey r much worse off If everybody can claim it is his human right to come bu boats how many millions would we get? Hungary &Italy r against uncontrolled migration When we had 54k it cost $3bils to detain

Your confusing genuine asylum seekers escaping death to economic illegal migrants....

There are a number of legal minds who are 'CYA' with regard to this controversial issue. That those spoken to from the hallowed halls of academia can't comprehend the idea that 1000 individuals in detention for no crime at all can represent a crime against humanity is ludcicrous.

'Crimes against humanity'? FFS. They can leave any time they like. Never let it be said that the ABC doesn't pursue an extreme left wing agenda so that the ones who are just left wing think they are represent the centre.

Umm, yes obviously!

Irony

Yes

Are some activists guilty of lawfare stupidity against common sense?

What about the Left’s crimes against humanity: Exposing children to LGBT propaganda in schools Systematic marginalisation of White majority via multiculturalism Indigenous child abuse sustained by Leftist policies Socialist indoctrination of children in public education

MSMWatchdog2013 So the ICC is toothless ?

Yes

no

What a pos article 🙄 containing no facts . ..ABC no credibility

Maybe Labor & the Greens for the 1200 people killed at sea.

Sure looks that way.... Hague

When will abc bring to attention the crimes against humanity that the asylum seekers have inflicted on the Nauru and Manus community?

No, despite what shreiking leftards tell you

Straight up yes. We already know that the conditions inflicted upon asylum seekers was torture, there's no question that the government has committed crimes against humanity.

ABCFactCheck Yes

Another independent not worth a spit.

ABCFactCheck We taxpayers pay for this stupidity ....

Yes

No

This is a BULLSHIT non event, certainly NOT a fact check of Wilkies allegations

Yes.

What about all the boats and drownings stopped!

The left wing lynch mob are in kahoots with GetUp to bring down the government and install billshortenmp and they have the gall to pull a politically motivated fact check? That’s about as credible as sending Zoe Daniel to Hanoi to cover the summit.

What a fake news joke the ABC is.

Another Fact Check that does not check any facts!!

no

The sharks are circling — and it's asylum seeker policy in the 'chum bucket'For all the blood and guts hurled in Parliament this week, the question of how much real change has occurred in our treatment of asylum seekers is very murky. To think we pay these clowns to throw chum buckets at each other in parliament is absolutely beyond me. What an absolute disgrace! Not one politician showed any integrity and dignity in the execution of their office. Yep the ABC is worried, which can only be a good thing. This should be a non issue , that it is is insulting to Australians in general , I was hoping we were a bit better than the Americans but we will see at the election.

Senator Simon Birmingham defends plan to send asylum seekers to Christmas IslandAustralia has defended the quality of medical facilities on Christmas Island, where asylum seekers in offshore processing could be sent for treatment. How about we send Senator Birmingham to Christmas Island the next time he needs medical treatment? Let's see how 'adequate' he thinks it is then. MediVacBill Bullshit. Coughs and colds but not much else. Unless they set up a mobile hospital. Maybe HMAS Canberra/Adelaide, one of which is now en route to the Indian Ocean. Excellent, good news.
