While Malema's colleagues in Parliament debated Public Protector Advocate Busisiwe Mkhwebana’s fitness to hold office, the EFF leader was facing charges of allegations of discharging a firearm in public.

Julius Malema, the leader of the Economic Freedom Fighters, was not in Cape Town on Monday as he appeared in the East London Magistrates' Court.

The lobby group lodged the complaint against the EFF leader after a video of him firing gunshots emerged in 2018. Sergent Dwayne Francis, who took the witness box on behalf of the state, told the court that he had downloaded the video footage containing Malema’s incident and sealed it in a forensics evidence bag. He said there had been two clips of videos that he downloaded from a phone that belonged to Colonel Swaartbooi.
