Ontario's right to disconnect law too vague to be of much help for workers, experts say

There's little clarity around what to do, for example, if a colleague working a later shift has a question, or whether she's expected to respond if someone emails her at 10 p.m.

The new law has created buzz about its potential to give people peace of mind to tune out of digital communications at the end of the workday. But experts and stakeholders say it's too vague to really move the needle on work-life balance, particularly in the era of hybrid work. Julie Kwiecinski, director of provincial affairs for the CFIB, said she heard from many confused companies that they want to honour the law, but didn't get clear guidance on how to do that.

Employers that fail to set up a policy could be fined, but the ministry is taking an “education first approach.” The Employment Standards Act - and therefore the right to disconnect policy requirement - doesn't apply to employees of the Crown, the ministry said. But McNaughton said just being more aware of the issue has made a difference in his own office.

“Having this policy in place is driving a little more training to make them a little more self-sufficient, so that they don't need to call on people for day-to-day things,” he said. “It's helped us realize where we need to improve a little bit of our process.”

Let’s talk about time off. Sick, vacay. For most of us, our tasks don’t stop, we’re just supposed to make it up upon our return. I have anxiety about my emails, tasks piling up when I’m off.

My favorite part of our policy is the exceptions. Basically they will contact you whenever they want.

You can’t even take a sick day anymore. They just tell you to work from home now.

It's a nice idea, but if people and companies are already lying about overtime, what's stopping them from lying about this

Natch- you can only be expected to work when you are expected to work. Since most employees have established hours of work, it follows that employers can only expect workers to work at those times. The biggest impact is likely to be that bosses become more conscious of this fact!

Any type of after hour work should be considered OT. You don't have to pick up the phone, answer emails etc. for free. Now if you are being paid extra to be on-call then yes you are responsible to be connected 24/7. It's very simple.

The problem is mostansger have zero idea on how to measure productivity especially when employees do multiple tasks

Be specific like any time a worker is asked to work longer than usual, company pays them 5% of their annual salary, I am sure people won't ask employees to work over time.

It's just incredible how the truth about Ford's plans was kept under wraps by the media until after the election. Now they report 'honestly' on it because it's too late. We're stuck with them. The media saw to that. Just infuriating.

My company handles business in different time zones, so these rules mean nothing to me. If a customer in California needs help at 730pm eastern then I am available.
