The HSE spent over €1.2m in child disability legal cases after almost 300 cases came before the courts between 2018 and 2021 taken due to alleged breaches of the Disability Act

The Health Service Executive has spent over €1.2m in legal costs related to cases taken against it by families who felt that their children with disabilities had received inadequate care.

The majority of them related to the Assessment of Needs process, which identifies the health needs of children with disabilities. The HSE added that a small number of cases have been escalated to the Court of Appeal and Supreme Court. The HSE added that a separate case is before the Court of Appeal and that it is waiting for that ruling to be issued before it can progress with those reforms.
